So are you saying that this could be working with a recent Kernel?

I am still under the impression that BA 9.62 is a patch for Kernel 2.6.5 and
bridge-utils-0.9.5. Otherwise why would this guy in the howto downgrade his
Debian Sarge kernel from 2.6.8 to 2.6.5 and recompile everything after
installing BA? See here:
